South Dakota's winter rule runs Nov 1 to Mar 31

Can They Shut Off Your Heat in Winter in South Dakota?

South Dakota does not ban winter shutoffs, but from November 1 to March 31 a regulated utility has to give a residential customer 30 extra days beyond the usual notice, and a doctor's certificate buys another 30 days, while the Office of Energy Assistance pays heating costs for households under its income table.

What South Dakota requires of a utility in winter

November 1 to March 31

Between November 1 and March 31 a utility may not disconnect residential service without first adding 30 days to the normal notice period and telling the customer about that extra time, which delays a winter shutoff rather than barring one.

What switches it on
South Dakota Public Utilities Commission's rule runs from November 1 to March 31 and applies inside those dates on its own, without the household filing anything.

Who it reaches
The rule binds the utilities South Dakota Public Utilities Commission regulates. A household on a municipal system or a rural cooperative is covered by that system's own policy instead.
What the household must do
Nothing. Inside the rule it applies on its own.

That is South Dakota Public Utilities Commission speaking through its own rule, and the sentence below is the one the summary above was built from. The citation is South Dakota Public Utilities Commission, S.D. Admin. R. 20:10:20:10.

Notwithstanding the provisions of §§ 20:10:20:03 and 20:10:20:04, a utility may not disconnect residential service from November 1 to March 31 without adding to the time periods of subdivision 20:10:20:03(2) an additional 30 days before disconnecting that service. The utility shall notify the customer before the normal disconnection date that the customer has an additional 30 days until disconnection.

Who to call in South Dakota today

A physician or public health or social services official can certify that a shutoff would worsen an existing medical emergency, which postpones disconnection for a single 30 day period, and a delinquent bill may be paid at any point before the service is cut.

a utility shall postpone the disconnection of utility service to a residential customer for 30 days from the date of a physician's certificate or a notice from a public health or social services official which states that disconnection of service will aggravate an existing medical emergency of the customer, a member of the customer's family, or other permanent resident of the premises where service is rendered. Such extensions are limited to a single 30-day period.

A commission’s consumer division is not a courtesy line. In most states a company must hold a disconnection while a formal complaint about that account is open, which is a different and stronger thing than asking the company to reconsider. Ring the utility first, then the commission if the answer is no.

This is where an electric disconnection physically happens, and it is also why the rules are written by a public utility commission rather than a legislature in a good many states: the commission regulates the company that owns this wire. “Residence service drop”, Chetvorno, CC0
Who it covers

Does the South Dakota rule cover your utility

The rule binds the utilities South Dakota Public Utilities Commission regulates. A household on a municipal system or a rural cooperative is covered by that system's own policy instead.

That means a rural electric cooperative and a municipal light or gas department in South Dakota answer to their own board or their own city council on this, not to South Dakota Public Utilities Commission. Many adopt a winter policy of their own that is as protective or more so, and the place to find it is the cooperative's or the town's own tariff.

The rule names electric and natural gas service.

Help with the bill

South Dakota pays part of the heating bill through Low Income Energy Assistance Program (LIEAP)

A shutoff rule and a heating grant are separate things, and in several states an approved grant application is itself what satisfies the filing the shutoff rule asks for. South Dakota Department of Social Services, Office of Energy Assistance runs it. The income test is The department publishes a three month gross income limit table for the 2025-2026 heating season rather than a stated percentage, and a household must be at or below the limit for its size..

South Dakota winter shutoff questions

A state rule can reach a regulated gas company and not reach the electric cooperative next door, or the reverse, so the protection you have often depends on which company sends which bill. “Gas meter”, RadRafe, Public domain

South Dakota read September 23, 2026 from Article 20:10:20, Disconnection of Utility Service, South Dakota Administrative Rules, linked above. A commission can order a company to do something its published rule does not require, and rules change between seasons, so the agency page is the one that governs. Every state is on the winter shutoff hub.
